Terms and Conditions
By placing an order or making a booking with DK Capture Photography (“DK Capture”), you (“the Client”) agree to be bound by the following terms and conditions. These terms govern all agreements between DK Capture and the Client, whether written or verbal, for the provision of photographic services and/or the sale of goods and digital products.
1. Payments and Booking
1.1 Payment for studio sittings, including makeover sessions, is required at the time of booking.
1.2 Orders for additional goods or services (e.g., prints, digital files, albums, canvases) must be paid in full upon ordering. Once an order is confirmed and in production, it cannot be amended or refunded.
1.3 Prices are as per the current price list or written quotation. DK Capture reserves the right to amend pricing at any time without notice. In the event of a pricing error or technical fault, a full refund will be issued, and the order will need to be resubmitted.
1.4 A deposit is required to secure voucher bookings. A £10 administration fee applies for extending expired vouchers. All deposits and sitting fees are non-refundable.
2. Cancellations & Rescheduling
2.1 All booking payments are non-refundable.
2.2 Bookings may be rescheduled with a minimum of 48 hours’ notice.
2.3 Clients arriving more than 20 minutes late without prior notice may have their session cancelled without refund.
2.4 For commercial bookings, cancellations made within three working days of the scheduled session will incur a £125 cancellation fee.
3. Invoices and Late Payments
3.1 Invoice payments are due immediately upon receipt.
3.2 No images may be used or published until full payment has been received.
3.3 Payments not made within 30 calendar days are subject to a late payment fee of £55.
3.4 DK Capture reserves the right to charge statutory interest at 8% above the Bank of England base rate under the Late Payment of Commercial Debts (Interest) Act 1998.
4. Liability and Force Majeure
4.1 In the event of cancellation by DK Capture due to illness, equipment failure, extreme weather, or force majeure, all monies paid will be refunded in full.
4.2 DK Capture’s total liability shall be limited to the amount paid by the Client for the services or goods.
4.3 DK Capture accepts no liability for loss, damage, or corruption of digital media not caused by its own negligence.
5. Health & Safety
5.1 The Client is responsible for their own safety and that of any minors attending.
5.2 Clients are liable for any damage caused to the property or equipment during their session.
5.3 DK Capture accepts no responsibility for loss or damage to personal belongings.
5.4 Photography sessions may involve physical activity undertaken at the Client’s own risk.
5.5 Clients must inform DK Capture of any medical or access requirements prior to the session.
6. Vouchers and Credit
6.1 Vouchers and credits are valid for the date stated or 6 months from the date of issue unless otherwise agreed.
6.2 Vouchers are non-transferable, non-refundable, and cannot be exchanged for cash.
6.3 Only one voucher may be used per sitting. Expired vouchers may be extended for £10.
6.4 Third-party deal vouchers are valid for new clients only. Use by existing clients may result in forfeiture of the voucher and payment of administrative costs.
7. Travel
7.1 Standard travel is included up to 10 miles from BH10 7EB.
7.2 Additional mileage and any required accommodation will be charged and agreed upon at the time of booking.
8. Image Proofing
8.1 Image selection is at the discretion of DK Capture.
8.2 Image proof access will be restricted to pre-approved parties. DK Capture accepts no responsibility for unauthorised sharing of access credentials.
9. Confidentiality
9.1 Both parties agree to treat all terms of the Agreement as confidential, except where disclosure is required by law.
9.2 DK Capture may use images and the Client’s name for promotional purposes, unless the Client expressly declines in writing.
10. Copyright
10.1 All images remain the copyright of DK Capture under the Copyright, Designs and Patents Act 1988.
10.2 The Client is granted a personal, non-commercial licence unless a separate commercial agreement is made in writing.
10.3 Images may not be copied, scanned, or reproduced without prior written permission.
10.4 DK Capture reserves the right to use and reproduce images for marketing, promotional, and artistic purposes.
10.5 Clients sharing or posting unpurchased images on social media agree to purchase all images from their session at full price.
11. Image Retention
11.1 Digital images will be retained for four (4) months from the date of the session.
11.2 Uncollected print orders will be recycled after 35 days.
12. Liability & Indemnity
12.1 The Client agrees to indemnify DK Capture against all claims, legal fees, and costs arising from unauthorised use or modification of images.
12.2 Liability is limited to the total value of the invoice for the goods or services in question.
13. Refund & Exchange Policy
13.1 In the event of faulty goods, a replacement will be offered. If this is not possible, a refund will be issued excluding delivery charges.
13.2 Returns must be made within 7 days of receipt in original condition and packaging.
13.3 Digital files are non-refundable once supplied.
13.4 Refunds (if applicable) will be issued via the original payment method within 14 days.
14. Interpretation
14.1 No variations to these terms shall be binding unless agreed in writing by DK Capture.
14.2 These Terms and Conditions shall be governed and construed in accordance with the laws of England and Wales.
